Work

1. How many days can I work during my studies?

International students who do not come from the EU, EEA or Switzerland may work 140 full or 280 half days per year or 20 hours per week.
You do not need the approval of the Immigration Office for this.
If you want to work more than 140 full or 280 half days or 20 hours per week per year, you need the approval of the Foreigners' Registration Office.

One exception, however, is work as an academic or student assistant at the university or as a tutor at the student union: as long as your studies are not at risk, this work can be carried out for an unlimited period of time.
However, the Foreigners' Registration Office must be informed.

2. Can I become self-employed or register a business during my studies?

International students from third countries may only work independently with the permission of the immigration authorities! In some residence permits, permission for self-employment is already noted and does not have to be applied for separately.

3. Is it possible to work if I have not yet received my residence permit?

The ancillary provisions of the fictitious certificate issued must be observed here.

4. I currently only have a fictitious certificate. My employer wants to see the valid residence permit because of my employment contract. He does not accept a fictitious certificate. What should I tell the employer?

You have applied for an extension of your residence permit.

We would like to point out that if you already had a valid residence permit (within the meaning of Section 4 (1) sentence 2 of the Residence Act) and applied for its renewal in good time before it expired, the old residence permit will continue to apply even if it has expired in the meantime (Section 81 (4) sentence 1 of the Residence Act). A work permit, if applicable, also remains valid. However, this does not apply to holders of a Schengen visa (short-stay visa) who have applied for a residence permit.

5. Am I allowed to work during my studies with a Job Seeker Visa?

No.
However, as soon as a suitable job has been found, you can apply for a residence permit in accordance with Section 4 of the Residence Act.

6. I would like to work in Germany after my studies. Which residence permit do I need? When and how do I apply for it?

If you do not yet have a concrete job offer and are looking for one, you will need a residence permit in accordance with § 20 Para.
1 No. 1 AufenthG.
This is issued for a maximum period of 18 months.
This entitles you to gainful employment without restriction.

If you already have a job offer, apply for a residence permit for employment in accordance with Section 4 of the Residence Act (§ 18b - 21 AufenthG).
